Where and how do you change name (ownership) of a uk property within a family?

my sister bought a home and shes paying for it on mortgage and i (brother) want it in my name with my sister permission considering i live in a different home,can it been done if so how? also can my sister carry on paying mortgage for home or does new owner (me) need to apply for mortgage before changing names?



i appoligise if this is confusing ,were 1st time buyers.

You can't transfer ownership without the permission of the mortgagor which he would not give. This is because his title would be compromised by the fact that he could not sell the property with vacant posession if the borrower defaulted.



Even if you refinanced, this arrangement would become a legal minefield;



If the house has an equity value of 拢20,000 then the transfer would be a gift from her to you of this amount. Having given you the house, she would then have to pay you rent or it would be considered a 'gift with reservations' and potentially invalid. The rent would need to be a market rate and will be taxable income to you. You could offset this with the mortgage payments and other expenses as you will be running the property as a rental. A property can be given by a deed of gift. Go to a solicitor and ask him/her to draw up a document giving the ownership ( or part-ownership) to the other person.

Then register the ownership with the Land registry, or ask the solicitor to do it for you.

Warning!

If the property has some asset value instead of just ( say) a nearly 100 percent mortgage, so that a valuable gift is transferred, you may have to pay GiftTax to the government. The solicitor should be able to advise on this, too.
