You'll have to retrieve that illegally copied music off of the ipod first, restore the iPod in iTunes and rename it, import the illegally copied music into iTunes, and then sync the illegally copied music back on to the iPod with iTunes.

Ok so you plug it on to iTunes, and there's a spot on the left hand side that says ____'s iPod, or something like that. Just click twice on that and type in the name you want and press enter.
