we have orginal death certifcate. Now what do we do to remove person from deed?How to change name on deed after person has died?
You probably have to go through probate court. YOu cant just change a name on a deed.How to change name on deed after person has died?
You can not. Real Estate passes several ways. If more than one name was on the deed, then the survivor owns the property.



If the decedent left a will, the Will determines the owner(s) if No Will, state law determines........In any case you will have to show the probate court or the clerk who the new legal owner is and how the property passed.
Unfortunately its not that simple and there are many questions here. One, was there anyone else on the deed. Two, what state does the property reside in? Three, was the individual that passed married? Four, if married, is the spouse still alive? Five, is there a will? Hopefully there is a will, but the other questions do have to be answered in order to give you a detailed response. In general, the estate will have to go through probate, and once probate is completed, the executor of the estate has a deed recorded in the new, rightful owners name.
